Stake Brasil has secured a provisional court injunction that preserves its betting authorisation and lets it continue operating under the conditions set by the Federal Court of São Paulo, the company said on 9 October 2026. The 9th Federal Civil Court of São Paulo granted a partial preliminary injunction against Provisional Measure 1,394/2026.

The ruling provisionally preserves the effects of Stake Brasil’s authorisation to operate fixed-odds betting in Brazil.

Under the decision, which remains effective until 25 October 2026, Stake Brasil’s authorisation remains valid, its website at stake.bet.br cannot be blocked or redirected, and sanctions cannot be imposed on the company for operating within the conditions established by the court.

To Stake Brasil’s knowledge, it is the first licensed operator to obtain a decision of this kind.

Stake Brasil views the ruling as an important signal for businesses operating under government authorisation and supervision.

The company said it is important to recognise the legal position of operators that have fulfilled regulatory requirements, paid the applicable authorisation fees and made significant investments in the regulated market.

According to Stake Brasil, the decision reinforces the importance of legal certainty and regulatory stability, particularly where businesses have acted in accordance with the requirements established by public authorities.

Consumer protection

Stake Brasil said consumer protection remains one of the principal benefits of a regulated betting market. The company believes that clear rules, responsible gambling mechanisms and oversight by public authorities are essential to ensuring effective consumer protection.

Since the publication of the Provisional Measure, Stake Brasil has complied with the obligations imposed and says it will continue to observe both the measure and the determinations of the judiciary.

Industry context

Provisional Measure 1,394/2026 was published in Brazil’s official gazette on 25 September 2026, according to the Federal Senate’s legislative summary. It bans the operation, advertising and intermediation of fixed-odds betting on sports events and online games, including operators serving players in Brazil from abroad, and blocks new authorisations. Existing authorisations are extinguished 30 days after publication, which falls on 25 October 2026, with no refund of the authorisation fee.

EpicWins reported that Brazil’s 85 authorised operators each paid R$30 million for five-year authorisations, R$2.55 billion in total, as covered in its report on the ban’s first days. The same story noted that around 180 industry executives and lawyers planned to take the ban to the Supreme Federal Court (STF).

Under Brazil’s Constitution, a provisional measure takes effect immediately and lapses unless Congress converts it into law within 60 days, a period that can be extended once by another 60. Affiliate group Gentoo Media cut its 2026 guidance after the ban, EpicWins reported on 1 October.
